By requesting, purchasing, approving or engaging any product or service from Bubble Bekkie Advertising (PTY) Ltd, the client acknowledges and agrees to these Terms and Conditions. These Terms and Conditions apply to all services unless a separate written agreement states otherwise.
1. INTRODUCTION
1.1 VAT Status
Bubble Bekkie Advertising (PTY) Ltd is not VAT registered. Prices are therefore not subject to VAT unless otherwise stated.
1.2 No Guaranteed Results
Bubble Bekkie Advertising provides professional digital marketing, website, SEO, advertising, branding, design and related services.
Marketing results depend on factors outside the Agency’s direct control, including competition, market conditions, customer behaviour, advertising budgets, search engine algorithms, social media algorithms, platform policies and third-party systems.
The Agency does not guarantee specific rankings, leads, sales, conversions, website traffic, engagement, reach, advertising results or revenue.
1.3 Client Cooperation
The client is responsible for providing accurate information, content, images, approvals, access and other materials reasonably required to perform the agreed services.
Delays caused by the client, including delayed content, approvals, payments or access, may affect the project timeline.
1.4 Authorised Client
Services are provided to the registered client or authorised representative unless otherwise agreed in writing.
Only an authorised person may provide instructions, approve work or request changes on behalf of the client.
1.5 Professional Services
The Agency provides services according to the agreed scope of work.
The Agency is not responsible for losses, interruptions, technical failures or performance issues caused by third-party platforms, hosting providers, domain registrars, website software, plugins, previous developers, external agencies, client actions or circumstances outside the Agency’s reasonable control.
2. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Where appropriate, the parties will attempt to resolve disputes through communication and good-faith negotiation before formal legal proceedings.
Nothing in these Terms and Conditions is intended to remove or limit any legal right or obligation that cannot lawfully be excluded under South African law.
3. QUOTATIONS
3.1 Quotation Validity
All quotations issued by Bubble Bekkie Advertising are valid for 3 calendar days from the date of issue unless otherwise stated in writing.
Once a quotation expires, pricing, availability, project timelines and other conditions may be reviewed and a new quotation may be required.
3.2 Quotations Are Based on Scope
A quotation is based on the information available to the Agency at the time it is prepared.
Where additional technical requirements, functionality, development work, repairs or third-party costs are discovered after work begins, the Agency may issue a revised quotation or additional quotation before undertaking that additional work.
3.3 Existing Websites
A detailed quotation for work on an existing website, online store, website backend, hosting environment or third-party website system may require a Technical Audit Report before the quotation is prepared.
The Agency cannot accurately price technical work without first understanding the existing system and determining what has already been implemented, what is functional, what is incomplete and what work is required.
3.4 No Free Technical Audits or Detailed Technical Quotations
Technical audits, backend investigations, website inspections, technical assessments and detailed quotations requiring investigation of an existing website are not provided free of charge.
Where a technical assessment is required, the applicable R2,500 Technical Audit Report fee must be paid before the assessment is performed.
General enquiries and standard pricing information do not constitute a technical audit or detailed project quotation.
4. TECHNICAL AUDIT REPORT
4.1 Purpose of the Technical Audit
The Technical Audit Report is a paid professional assessment used where Bubble Bekkie Advertising needs to inspect an existing website or digital system before determining the work and cost involved.
The audit may identify:
- Existing website structure.
- Website functionality.
- Existing design implementation.
- Technical issues.
- Website speed issues.
- SEO issues.
- Mobile responsiveness.
- Existing plugins and integrations.
- Website configuration.
- Existing development work.
- Missing functionality.
- Required updates.
- Potential compatibility issues.
- Work required to achieve the client’s requested outcome.
4.2 Technical Audit Fee
The Technical Audit Report fee is R2,500 unless otherwise stated in writing.
The fee must be paid and cleared before the Agency performs the audit.
4.3 Backend Access
After payment of the Technical Audit Report fee, the client must provide appropriate authorised backend access where such access is reasonably required to perform the assessment.
The Agency may require administrator, editor, developer or another appropriate level of access depending on the website and the work being assessed.
4.4 No Unnecessary Access
Bubble Bekkie Advertising does not require clients to provide unnecessary access.
Where possible, clients should create a dedicated user account for the Agency rather than providing personal passwords.
4.5 Audit Fee Is Earned
The Technical Audit Report fee pays for the Agency’s professional time and technical assessment.
If the client decides not to proceed with the recommended work after receiving the audit and quotation, the R2,500 audit fee remains payable and is not automatically refundable.
4.6 Audit Fee Credit
If the client accepts the resulting quotation and proceeds with the full quoted project, Bubble Bekkie Advertising may credit the R2,500 Technical Audit Report fee against the project cost where this is specifically stated in the quotation.
The audit fee does not automatically become a deposit or project payment unless the quotation expressly states that the fee will be credited.
5. EXISTING WEBSITE HOSTING AND BACKEND ACCESS
5.1 No Hosting Transfer Required
Clients are not required to move their website, domain or hosting to Bubble Bekkie Advertising in order to receive website-related services.
Where technically possible, Bubble Bekkie Advertising can work directly on the client’s existing website backend and existing hosting environment.
5.2 Existing Hosting Providers
The client’s website may remain hosted with its current hosting provider.
The Agency does not require hosting migration merely because the Agency is performing website maintenance, development, optimisation or other website-related work.
5.3 Hosting Migration May Be Recommended
Bubble Bekkie Advertising may recommend hosting migration where the existing hosting environment is:
- Technically unsuitable.
- Insecure.
- Unreliable.
- Incompatible with the required work.
- Too restrictive for the required functionality.
- Causing performance problems.
- Preventing the Agency from safely completing the agreed work.
Any hosting migration will be discussed with the client and will not be performed without the client’s approval.
5.4 Previous Developers
The Agency is not responsible for technical problems caused by previous developers, designers, hosting providers, plugins, themes, custom code, third-party integrations or other external parties.
Where such problems require additional work, the additional work may be quoted separately.
6. PAYMENT TERMS
6.1 Prepayment
All services are strictly prepaid unless otherwise agreed in writing.
No project work will commence until the required payment has cleared.
6.2 Invoice Validity
Invoices are valid for 3 calendar days unless otherwise stated in writing.
An expired invoice may be cancelled and reissued at the Agency’s discretion.
6.3 Payment Methods
Bubble Bekkie Advertising accepts payment by Electronic Funds Transfer (EFT) or bank transfer into the business bank account specified on the invoice.
Payment must be made using the invoice reference provided to ensure that the payment can be correctly identified and allocated to the client’s account.
The client is responsible for ensuring that the full invoiced amount is paid and that the funds have cleared before work commences.
Proof of payment may be requested, but the submission of proof of payment does not constitute confirmation that funds have cleared.
6.4 No Work Before Payment
The Agency is not required to commence work, reserve production capacity, purchase materials, begin development or provide deliverables before the required payment has cleared.
7. LATE PAYMENTS
Where an invoice becomes overdue:
- A R250 administration fee may be charged per overdue invoice.

Complex projects may require longer timelines.
8.3 Client Delays
The Agency is not responsible for delays caused by:
- Missing content.
- Late approvals.
- Delayed payments.
- Delayed backend access.
- Client-requested changes.
- Third-party providers.

- Technical problems inherited from previous developers.
8.4 Additional Functionality
Functionality not included in the original quotation may require an additional quotation.
9. WEBSITE MAINTENANCE AND WORK ON EXISTING WEBSITES
When Bubble Bekkie Advertising works on an existing website, the Agency will work within the agreed scope.
Existing websites may contain technical problems that are not immediately visible.
The Agency may identify additional issues during development.
Where additional work is required, the client will be informed and the additional work may require a separate quotation.
The Agency is not responsible for unrelated defects that existed before the Agency commenced work.

13.2 Advertising Budget
Advertising spend paid to third-party platforms is separate from the Agency’s management fee unless specifically included in the package.

No specific advertising results are guaranteed.
Campaign performance depends on budget, competition, audience behaviour, creative quality, platform algorithms, market conditions and other factors.
14. BOOSTED POSTS AND ADVERTISING CAMPAIGNS
Where a package specifically includes a boost or advertising allowance, the applicable allowance will be stated in the product description or quotation.
Any included advertising allowance is subject to the specific terms of the selected package.
Advertising spend is subject to the relevant third-party platform’s billing and advertising policies.
