By accessing or using any of our services—including website design, e-commerce, hosting, SEO, digital marketing, printing, consultations, or courier fulfilment—you agree to the following terms. These terms ensure professionalism, clarity, and fairness for all clients and are legally binding under South African law.
1. Introduction
VAT Status: Bubble Bekkie Advertising (PTY) Ltd is not currently registered for VAT. All invoices exclude VAT.
No Guarantees: Marketing success depends on consistency, offering, and effort. Outcomes such as leads, sales, or reach are not guaranteed.
Joint Effort: Full cooperation is required from you to ensure successful delivery.
Portfolio Rights: Completed work may be featured in our portfolio unless otherwise agreed in writing. Confidential projects will not be displayed without explicit written consent.
Direct Clients Only: All contracts are between Bubble Bekkie Advertising and the client; third parties may not act on your behalf.
2. Legal Compliance & Dispute Resolution
Applicable Law: Governed by South African law.
Dispute Resolution: Arbitration will be pursued before any legal action.
Jurisdiction: Any disputes shall fall under the jurisdiction of the Magistrate’s Court of Villiers, Free State, or another competent court within South Africa.
3. Payment Terms & Service Suspension
Upfront Payment Required: Work begins only after full payment or confirmed financing.
Payment Options: PayFast or Yoco (secure checkout). PayFast also allows approved financing solutions such as MobiCred.
Special Requests: Custom payment arrangements require a written agreement before work begins.
Late/Unpaid Invoices: Services may be paused or removed without notice if payment is not received on time.
Special Pricing Clause: Discounts exclude free reworks or extended time. Clients must supply all materials within 3 business days of brief delivery. Late submissions may be declined or billed separately.
4. Social Media & Design Services
Setup Fees: Non-refundable.
Prepaid Services: Monthly fees payable in advance.
Performance Disclaimer: No guarantees for reach, followers, or conversions.
Meetings & Revisions: Requests must be submitted in writing; billable unless part of a package. Repeated delays or vague feedback may cause project delays.
5. Website Design, E-Commerce & Hosting
Full Payment Upfront: Turnaround is 7–10 business days after receiving full content.
Domain Registration: Registered under Bubble Bekkie Advertising for security. Ownership can be transferred upon request.
Backend Access: Not provided unless agreed in writing. If granted, we are not liable for issues caused by third-party modifications.
E-Commerce Products: Up to 100 products included; additional billed separately.
Client Responsibility: Clients must provide correct content, login information, and assets.
6. Buyer Protection (Including Completion Guarantee)
To protect our clients, Bubble Bekkie Advertising offers Buyer Protection on all services:
Secure Payment: PayFast- and Yoco-secured checkout.
Completion Guarantee: If your project is delayed on our side (not due to missing client content), we will complete it at no additional cost.
Defined Timelines: Each package specifies turnaround times.
One Revision Round: Included where applicable; extra edits may incur fees.
30-Day Technical Support: Post-launch support for websites and hosting.
Refunds are generally not applicable since all work is custom. Instead, our Buyer Protection and Completion Guarantee ensure delivery.
7. SEO Services
Included: Keywords, meta tags, site speed, sitemap, Cloudflare CDN.
Excludes: Major coding or redesigns unless quoted.
Ownership: All strategies and documentation remain our intellectual property.
Disclaimer: SEO results take time; no ranking guarantees.
8. Printing & Nationwide Delivery
Production Timeframes: Design & proofing 3–5 business days; production 10 business days; courier 3–5 business days via The Courier Guy.
Reprints: Only for confirmed errors or courier damage reported within 24 hours.
Variations: Small tolerances in size and colour accepted.
9. Consultations & Strategy Sessions
Free Consultations: For new clients only.
Existing Clients: R450/hour, payable in advance.
Bookings: Require pre-payment.
Unpaid Time: Requests via phone, WhatsApp, or email are not handled unless paid.
10. Intellectual Property & Third-Party Use
All work remains property of Bubble Bekkie Advertising unless otherwise agreed.
No reselling, rebranding, or outsourcing without consent.
Reports and strategies are confidential.
11. Deadlines, Submissions & Delays
Clients must submit materials within 3 business days of draft delivery.
Missed deadlines may defer the project.
Time-sensitive work must be booked in advance.
Revisions outside the original scope may incur fees.
12. Errors, Omissions & Prohibited Use
We may correct errors in pricing or details without notice.
Clients may not use services to break laws, infringe intellectual property, misrepresent work, or submit malicious content.
13. Disclaimer of Warranty & Limitation of Liability
Services are provided "as is."
Bubble Bekkie Advertising is not liable for indirect or consequential damages, including downtime, courier delays, supplier issues, or algorithm changes.
Total liability is limited to the amount paid for the specific service.
14. Third-Party Feedback Disclaimer
External opinions (from freelancers, agencies, or consultants) may be biased. Independent audits require written agreement.
15. Termination
All cancellations must be in writing.
Social Media, Hosting, SEO, and Websites: 30 days’ notice before next billing cycle.
Design Services: 5 business days’ notice.
Completed Work: Payable in full before release. Intellectual property remains ours until payment clears.
Unpaid balances remain enforceable.
Breach may result in immediate service suspension.
16. POPIA & Client Privacy
We do not collect or store IP addresses.
All client content stored securely.
Clients are responsible for content accuracy.
No sharing of data with third parties unless legally required.
