By accessing or using any of our services—including design, printing, digital marketing, consultations, or courier fulfilment—you agree to the terms below. These terms ensure professionalism, clarity, and fairness for all clients and are legally binding under South African law.
1. Introduction
By using our services, you agree to the following:
Not VAT Registered: All invoices exclude VAT.
No Guarantees: Marketing success depends on consistency, business offering, and your own effort. No outcomes (sales, leads, reach) are guaranteed.
Joint Effort: We require your full cooperation to ensure service success.
Portfolio Rights: We may feature completed work in our portfolio, unless agreed otherwise.
Direct Clients Only: All contracts are between Bubble Bekkie Advertising and the direct client. No third party may act or instruct on your behalf.
2. Legal Compliance & Dispute Resolution
Applicable Law: South African law governs this agreement.
Dispute Resolution: Arbitration will be pursued before legal action.
Jurisdiction: Magistrate’s Court of Villiers, Free State (or nearest competent court).
3. Payment Terms & Service Suspension
Upfront Payment Required: No work begins without full upfront payment.
No Part Payments: Unless formally agreed in writing.
Late/Unpaid Invoices: Services, websites, and design work will be paused or removed without notice if payment is not received on time.
Time Is Money: Unpaid meetings, follow-ups, and redesign requests without confirmation will not be entertained.
Special Pricing Clause: Discounted pricing does not include free reworks or extended time. Clients receiving a special rate must submit all materials (e.g., photos, changes, ideas) no later than 3 business days after brief delivery. Any late changes may be declined or charged separately.
4. Social Media & Design Services
Setup Fees: Non-refundable.
Prepaid: Monthly fees payable in advance.
Performance Disclaimer: No guarantees for reach, followers, or conversions.
Meetings & Revisions: Requests must be submitted in writing. Meetings are billable unless part of a paid consultation package. Repeated delays or vague feedback will result in project delays.
5. Website Design & Hosting
Full Payment Upfront: Turnaround: 5–7 business days after full content is received.
Domain Hosting: Domains remain in our name during the active service period.
Backend Access: Not provided unless agreed.
E-Commerce: Up to 100 products included; extra listings are billed.
Client Responsibility: You must provide correct login info, photos, and text.
6. SEO Services
Included: Keywords, meta tags, site speed, sitemap, Cloudflare CDN.
Excludes: Major coding changes or redesigns unless quoted.
Ownership: All strategies, research, and SEO documentation remain our intellectual property.
Disclaimer: SEO takes time—no ranking guarantees are made.
7. Printing Services & Nationwide Delivery
Bubble Bekkie Advertising now official offers custom large-format printing, banners, decals, signs, and marketing materials.
7.1 Production Timeframes
Design & Proofing: 3–5 business days.
Production: 10 business days after approval.
Courier: 3–5 business days (via The Courier Guy).
Nationwide Delivery: Tracking provided.
7.2 Returns & Reprints
No Refunds for custom print jobs once production starts.
Reprints Only for confirmed errors or courier damage, reported within 48 hours of delivery.
Custom Sizes & Colour Tolerance: Minor variations are expected and accepted.
8. Consultations & Strategy Sessions
Free Consultations: For new clients only.
Existing Clients: Support is billed at R450/hour.
Bookings: All strategy or rescue sessions require pre-payment.
Unpaid Time: Requests via WhatsApp, phone, or email that require strategy input or ongoing changes will not be handled unless payment is made.
9. Intellectual Property & Third-Party Use
All creative work remains the property of Bubble Bekkie Advertising unless otherwise agreed.
No reselling, rebranding, or outsourcing allowed.
No use of our material by freelancers or other marketers without consent.
Reports and strategy documents are confidential and may not be submitted for review to other agencies or consultants.
10. Deadlines, Submissions & Delays
To prevent project delays and ensure high-quality delivery, clients must submit required materials (photos, feedback, captions) within 3 business days of receiving drafts.
Missed deadlines may result in project deferral to the next open slot.
Time-sensitive work must be booked in advance.
Design revisions that fall outside of the original scope or brief will incur additional fees.
Clients receiving discounted rates are expected to submit info timeously and will not receive extended creative consultations or free edits.
11. Refund Policy
No Refunds on setup/admin/design services once started.
No Refunds on printed products once in production.
No Refunds on websites after first draft sent.
Reprints only for confirmed printer error or courier damage.
12. Errors & Omissions
We reserve the right to correct errors in pricing or details without prior notice.
13. Prohibited Use
Clients may not use our services or platforms to:
Violate laws
Resell without agreement
Infringe on intellectual property
Misrepresent our work
Submit malicious or defamatory content
14. Disclaimer of Warranty & Limitation of Liability
All services are provided "as is". We are not liable for errors beyond our control including:
Hosting/server downtime
Platform updates (Facebook/Instagram/Google/etc.)
Courier delays
Supplier stock issues
Platform algorithm changes
15. Third-Party Feedback Disclaimer
Opinions from external consultants, freelancers, or marketing agencies about our work may be biased or aimed at upselling their own services. We discourage comparison-based audits unless discussed in writing.
16. Termination
All service cancellations must be submitted in writing.
Social Media, Hosting, SEO, and Website Services: Require 30 calendar days’ written notice prior to the next billing cycle.
Graphic Design Services: Require 5 business days’ notice before scheduled work begins.
All unpaid balances remain due and enforceable upon termination.
Breach of these terms may result in immediate suspension or termination of services without notice.
17. POPIA & Client Privacy
We do not collect or store IP addresses.
All client content is stored securely.
Clients are responsible for ensuring content accuracy.
We do not share data with third parties unless legally required.
