Thank you for choosing Bubble Bekkie Advertising (PTY) Ltd, a proudly South African, award-winning digital marketing, web design, and creative agency. By accessing or using any of our services, including website design, e-commerce, hosting, SEO, digital marketing, social media management, printing, consultations, strategy sessions, and courier fulfilment, you agree to be bound by the following Terms and Conditions. These terms are legally binding under South African law and are designed to ensure transparency, professionalism, and fairness for all parties.
1. Introduction
VAT Status:
Bubble Bekkie Advertising (PTY) Ltd is not currently registered for VAT. All prices and invoices exclude VAT.
No Guarantees:
Digital marketing and online performance results depend on multiple factors outside our control. No guarantees are made regarding leads, sales, rankings, reach, engagement, or conversions.
Client Cooperation:
Successful delivery requires timely cooperation, approvals, feedback, and content from the client.
Portfolio Rights:
Completed work may be featured in our portfolio, website, and marketing material unless otherwise agreed in writing. Confidential projects will not be displayed without explicit written consent.
Direct Client Relationship:
All agreements are strictly between Bubble Bekkie Advertising and the registered account holder.
2. Legal Compliance & Dispute Resolution
Applicable Law:
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Dispute Resolution:
Any dispute shall first be resolved through arbitration before legal action is pursued.
Jurisdiction:
All disputes fall under the jurisdiction of the Magistrate’s Court of Villiers, Free State, or another competent South African court.
3. Payment Terms & Service Suspension
Upfront Payment Required:
All services are strictly prepaid. Work will only commence once full payment has cleared or approved financing has been confirmed.
Payment Due Dates:
Invoices are payable on or before the due date stated on the invoice. No grace periods apply unless explicitly agreed in writing.
Accepted Payment Methods:
Payments are accepted via PayFast or Yoco secure checkout. PayFast may offer approved financing options such as MobiCred, subject to their own terms.
Custom Payment Arrangements:
Any alternative payment arrangement must be agreed to in writing before work begins. Verbal agreements are not valid.
Service Suspension:
If payment is late, incomplete, reversed, or disputed, Bubble Bekkie Advertising reserves the right to pause, restrict, or remove services immediately without notice until the account is settled in full.
3.1 Late Payment Fees & Administrative Charges
A late payment fee applies to any invoice not paid by the due date, including payments that are one day late.
Fee Structure:
• Fixed late payment administration fee of R250 per overdue invoice, and or
• Interest charged at up to 2 percent per month, calculated daily and compounded monthly, in line with South African commercial practice and the National Credit Act.
Recovery Costs:
All reasonable recovery costs, including administrative time, legal fees, and collection costs, may be recovered.
Repeated late payments may result in stricter payment terms or termination.
4. Social Media & Design Services
All setup fees are non-refundable.
Monthly services are billed in advance.
No performance guarantees are provided.
Revisions:
One revision round is included unless otherwise stated. Additional revisions, full redesigns, or repeated changes will be billed separately.
Unclear, changing, or excessive feedback may result in delays and additional charges.
5. Website Design, E-Commerce & Hosting
Full payment is required upfront.
Turnaround:
7–10 business days after receipt of all required content.
Domain Registration:
Domains may be registered under Bubble Bekkie Advertising for security purposes. Ownership transfers upon written request once accounts are settled.
Backend Access:
Backend access is not provided unless agreed in writing. Bubble Bekkie Advertising is not liable for third-party changes.
E-Commerce Limits:
Packages include up to 100 products unless otherwise stated.
6. Buyer Protection & Completion Guarantee
Payments are processed securely via PayFast or Yoco.
If a delay is caused by Bubble Bekkie Advertising, the project will be completed at no additional cost.
Refunds are generally not applicable due to the custom nature of services.
7. SEO Services
SEO includes keyword research, metadata optimisation, sitemap setup, basic speed optimisation, and CDN integration where applicable.
SEO results take time. No ranking or traffic guarantees are made.
All SEO strategies remain the intellectual property of Bubble Bekkie Advertising.
8. Printing & Nationwide Delivery
Production Timeframes:
Design and proofing: 3–5 business days
Production: Up to 21 business days
Courier: 3–5 business days via The Courier Guy
Only confirmed errors reported within 24 hours qualify for reprints.
9. Consultations & Strategy Sessions
Free Consultations:
Available to new clients only.
Existing Clients:
Consultations are billed at R750 per hour or part thereof, payable in advance.
Ongoing advice via WhatsApp, phone, or email is not included unless paid.
10. Third-Party Communication & Consultation Policy
10.1 Third-Party Communication
Bubble Bekkie Advertising conducts business strictly with the registered account holder only.
We do not engage with, respond to, consult with, or provide information to third parties, including consultants, freelancers, agencies, family members, employees, or helpers, unless:
• Written authorisation is provided by the account holder
• Authorisation is approved by Bubble Bekkie Advertising
• All consultation fees are paid in advance
Unauthorised third-party contact will be ignored or redirected.
10.2 Consultation Fees for Additional Queries
Any request outside the client’s active package scope, including:
• Strategy clarification
• Research or system pricing
• Technical explanations
• Advice requested via WhatsApp, phone, or email
• Questions from third parties
Will be billed as a paid consultation, even for existing clients.
Consultation Fee: R750 per hour, payable in advance.
No work, research, or pricing will be provided without payment.
10.3 No Free Advisory or Training
Bubble Bekkie Advertising is not a training provider or advisory helpline.
Reports and audits are informational only. Step-by-step fixes, corrective guidance, or implementation instructions are excluded unless quoted separately.
10.4 Abuse of Time & Boundary Enforcement
Bubble Bekkie Advertising reserves the right to limit communication, enforce consultation billing, suspend services, or terminate agreements where time abuse occurs.
11. Deadlines & Client Delays
Client materials must be supplied within 3 business days unless otherwise agreed.
Missed deadlines may result in deferred timelines.
Urgent work must be booked in advance.
12. Errors & Prohibited Use
We reserve the right to correct errors or omissions.
Services may not be used for unlawful activity, misrepresentation, or intellectual property infringement.
13. Disclaimer & Limitation of Liability
Services are provided “as is”.
Total liability is limited to the amount paid for the specific service.
14. External Feedback Disclaimer
Third-party opinions may be biased. Independent audits require written agreement.
15. Termination
Cancellations must be submitted in writing.
30 days’ notice applies to recurring services.
5 business days’ notice applies to design services.
Outstanding payments must be settled before release of work.
16. POPIA & Client Privacy
We do not collect or store IP addresses.
Client data is stored securely and not shared unless legally required.

18. Right to Amend Terms
